TERMS AND CONDITIONS
We suggest that you read the following terms and conditions of purchase carefully before placing an order. Keep in mind that the execution of any order through our online store implicitly implies acceptance of the Terms and Conditions developed below.
We inform you that once the purchase operation is completed, MESTRAE stores the content of all the contracts for the time stipulated by law.
AREA OF APPLICATION
A.1- These Terms and Conditions apply to any order placed by any user, and once the same has been made, the Terms and Conditions expressed in this space are accepted without reservation.
A.2- The present Terms and Conditions prevail over any document and its modifications will be binding unless it shows, as it is stated.
A.3- These Terms and Conditions are governed by Spanish law.
B.1- For the purposes of these Terms and Conditions:
a) "Order" refers to the order processed by our website www.mestrae.com
b) "customer" is the person who places the order and who is presumed to be of legal age.
c) "contract" refers to the order placed on a product following the instructions and adjusted to these Terms and Conditions.
d) "account" refers to the registration on the website to place orders.
e) "acknowledgment of receipt" refers to the acknowledgment of receipt sent to you by email.
f) "order confirmation email" refers to the email that is sent to confirm that your order has been successfully completed.
g) "Working day" means all those days that are neither Saturday, Sunday, or holidays, that is, from Monday to Friday, as long as it is not declared a public holiday by any Public Administration.
h) "breach of obligations" refers to any inappropriate use of the website and the subsequent actions for sale that attempt against the good use of the merchandise purchased.
i) The "clauses" are the clauses set forth in this Terms and Conditions.

k) "ordinary delivery"
l) "urgent extraordinary delivery", refers to the express delivery time chosen by the customer and has a different price than the ordinary one.

n) "breach of duty and of doing" refers to the breach of any obligation expressed, and to any common law obligation.
C- GUIDE TO PURCHASE, PAYMENT AND CONFIRMATION
1- To place an order effectively, you must enter the information requested in the purchase form designed for that purpose. All requested data will be necessary for the order to be confirmed and processed. Otherwise, the processing process will not end. The customer is responsible for the truthfulness of the information provided.
2- The price indicated on the website, includes I.V.A.
3- Payments are accepted by credit card in accordance with the rules established for online sales.
4- The client accepts to receive the invoices through the email provided during the purchase process.
5- The issuance of the order is associated with the current delivery of a contract. Mestrae is obliged to send you the paid product. From the moment you receive confirmation of receipt of your order, you start preparing it in our stores to send your order to the address indicated. If there is a problem, either with the product or transport, you will be informed of the incident immediately.
6- The mail order confirmation will include all the details of the purchase.
7- If the order had an error, please contact us as soon as possible to the email firstname.lastname@example.org and immediately proceed to its solution. If the incident is not communicated to us immediately (less than 12h) we can not assure you of its repair unless the error is referred to the delivery address, which can be communicated up to 24 hours after the confirmation of the order.
8- The product will be delivered to the address provided for this purpose during the purchase process. Any error in the same will only be imputable to the client, who must check it in his mail order confirmation.
9- Ordinary shipments will be delivered within 48-72h on working days, counted from the receipt of the order confirmation email. In exceptional cases, and after acceptance by the client, this period may be increased.
10- Make sure that the product is in perfect condition before signing the collection of it.
11- Orders placed for subsequent shipment to the Canary Islands may be subject to a customs tax and their delivery is higher than that of the peninsula. This information will be included in the purchase process that you must process.
12- Extraordinary or urgent shipments will be charged according to the modality chosen by the client.
13- Once delivered the product, after the signature of the client and therefore, to verify the status of the same, Mestrae is not responsible for the same if it has been delivered in perfect condition.
14- If the order can not be delivered to the delivery address provided by not being at home, the customer will expressly authorize Mestrae to transfer their contact information to the courier company in order to make the delivery.
15- The cancellation of the order for whatever reason, will entail the reimbursement of the payment made through the same form of payment used for the purchase and will extinguish the contract that had been signed by the purchase process. Mestrae is not obliged to indemnify the client for any related concept in this regard.
16- Mestrae guarantees the status of the product and the adjustment to the features previously described on the web. However, despite our efforts, it is possible that the product does not arrive in good condition or is considered defective, so in this unlikely event, and after checking the status of the same, we would proceed to the refund of the amount paid or change of the product, running the shipping costs on behalf of Mestrae.
In order for said return to be effective, the client must ensure:
- The product has not been used under any circumstances.
- It has not been tampered with, nor has it been damaged when trying to repair it.
- It has not deteriorated due to wear and tear.
17- In case of receiving a damaged product, as a consequence of the transportation, the client has 5 days to inform him of Mestrae. After this time, it will be understood that the product was delivered in perfect condition and no claim for "transportation" will be honored because it is considered late for such purpose.
18- Mestrae will offer, through the web page, the products out of season with a promotional price, which once delivered in perfect condition will not admit any refund under any circumstances.
1- Limited responsibility. This clause will prevail over all previous ones and defines the responsibility of Mestrae in the scope of the following points:
- Compliance and breach of the Terms and Conditions.
2- In no case will be excluded or limited:
- Liability regarding intent or gross negligence, any breach of our duty, any breach of the obligations established by Law 7/1196, RD 1906/1999, Legislative RD 1/2007, or any liability that can not be limited by the law or your rights as a consumer.
3- Mestrae Europe S.L. acts under the strictest current legislation with respect to the rights of consumers.
4- Mestrae Europe S.L. is not responsible in any case for:
- Loss or corruption of data.
- Loss of contracts.
- Loss of operating time.
- Any indirect loss.
5- Our responsibility for any contract and for any client, will not exceed 100 euros in any case.
6- Mestrae will not pay attention, in any case, to breach of contract due to force majeure. Understanding by force majeure natural disasters, actions of third parties.
7- In no case shall Mestrae be liable for personal injuries to the client or to a third party, which may be caused by using the commercialized product.
8- Mestrae guarantees the management of each and every one of the claims addressed to email@example.com or in its absence to Mestrae Europe S.L. Swiss street, 47. 11408 Jerez de la Frontera.

The use of any part of the website of www.mestrae.com implies the acceptance of these conditions, coming into force with any contact with it. If you do not agree with these conditions, leave the website.
